Thank you for visiting the WeBuyWatches.com website (hereafter referred to as the "Web Site", "we" or "us") and we appreciate this opportunity to work with you. We are eager to tell you how our watch purchase system works and to introduce you to the systems we have in place to protect your valuable watches and to provide superior customer service.

Your use of the Site is your representation and confirmation that you have read, understood and accepted these Terms of Service (hereafter "Agreement"). IF YOU DO NOT ACCEPT AND AGREE TO THESE TERMS AND CONDITIONS, YOUR ARE NOT ALLOWED TO USE THE SITE TO TRANSACT WITH US AND DO NOT SEND ANY WATCHES TO US.

The terms and conditions below are legally binding on you as a User of the WeBuyWatches.com service, the Web Site, and/or as a Customer of WeBuyWatches.com, and inure to the benefit of WeBuyWatches.com and its successors and assigns.

1. Requirements for use of the Web Site:

By requesting a shipping label and/or sending watches to us (individually, an "Item", and collectively, "Items"), using the Web Site, or otherwise conducting business with WeBuyWatches.com, you represent, warrant and agree that:
A. You are at least eighteen (18) years of age;
B. The information you submit to us is truthful and accurate;
C. You will update your contact information if it changes so that we can contact you;
D. You are not violating any applicable law or regulation;
E. You are the legal owner of any Items that you sell or are attempting to sell to us, or you are specifically authorized via some form of verifiable legal documentation to sell the Items to us;
F. Unless specifically authorized in writing as set forth above, you are acting on your own behalf and not as the agent or representative of another person; and
G. You intend and agree to be legally bound by these terms and conditions.

We may require documentation or other proof of compliance with any of these requirements and you agree to provide said documentation in order to complete a transaction as contemplated herein.

By proceeding to use this Web Site or offering to sell any Items to us, and agreeing to these Terms of Service, your agreement will act as an electronic signature certifying that you have met the all requirements listed above.

2. Your Representations:

You expressly represent, warrant and agree that you have (or if acting on behalf of or as agent or representative of another person, such person has), full, legal and unencumbered title to, and ownership of, every Item you will send or deliver to us and that you have full authority to solely engage in the transaction with us.

You agree that you will indemnify and hold harmless WeBuyWatches.com and all of our affiliates, agents, employees, officers, successors and assigns from and against any and all claims, suits, investigations, judgments, liabilities, obligations and damages relating to or arising out of the title to, ownership of, or lien on any Items you sold or purported or arranged to be sold to WeBuyWatches.com.

By sending your Item to us, you expressly agree that we will conduct all reasonable procedures and/or tests necessary to authenticate and/or determine the condition of your Item, including without limitation opening the back of the Item. You agree to bear all the consequences of allowing us to open the back of the Item such as but not limited to voiding of the warranty of the Item, if so existing.

DO NOT USE OUR SERVICE OR SEND YOUR ITEM TO US IF YOU DO NOT AGREE TO ANY OF THESE REPRESENTATIONS.

You certify that you are the rightful owner of the Items you wish to sell to us. Your agreement also certifies that the information you have provided to us is accurate, true and correct. This disclosure and your consent thereto follows Section 101(c) of the U.S. Electronic Signatures in Global and National Commerce Act ("E-SIGN"), codified at 15 U.S.C. Section 7001 et seq.

3. Initiating a WeBuyWatches.com Transaction:

In order to initiate a transaction with WeBuyWatches.com, you must complete the following steps:
A. First you must register with our Web Site by signing up using the form on the Web Site or via other registration options that we have available now or in the future.
B. Once you have registered for our service, we will contact you to make further inquiries about you Item and, if you agree, arrange shipment of your Item to us. In some instances, we will provide you with a shipping label for use with one of our shipping partners and will provide insurance for your Item in said shipment. In some situations, you will be responsible for shipping the Item to us and you will be responsible for obtaining insurance for the Item in your shipment.
C. You are solely responsible for packing the Item in your shipment to us.
D. All claims regarding damage during shipping shall be processed in accordance with and pursuant to the insurance policies and provisions of the shipping company utilized.
E. Once we receive your Item, we will evaluate said Item in preparation for making you an offer. As part of this evaluation of your Item, we will review the Item thoroughly including an examination of the internal workings of the Item. This means we will remove the back of the watch, which is necessary for us to properly evaluate the Item and make you an offer.

4. Offer to Purchase:

A. After receipt and evaluation of your Item, we will contact you at the phone number or email address provided in your registration with an Offer to Purchase the Item from you.
B. Upon your acceptance, whether oral or written, of such Offer to Purchase, you will be legally bound by such transaction and payment by check will be promptly sent to you. The transaction will be final and youYou will not have the opportunity or right to rescind the transaction or receive your Item back from us.
C. WeBuyWatches.com does not provide written appraisals and does not provide certified appraisals.
D. WeBuyWatches.com has the sole and absolute discretion to make or not make an Offer to Purchase for any Item.

5. Rejection of Offer to Purchase:

If you reject our Offer to Purchase, we will gladly return your Item to you. You must pay the return shipping costs. We will gladly purchase insurance for your Item on your behalf for the return shipment and in an amount of your choosing. All claims regarding damage during shipping shall be processed in accordance with and pursuant to the insurance policies and provisions of the shipping company utilized and WeBuyWatches.com will have no liability whatsoever in connection with the return of any Item to you. Prior to shipping your Item to you, you must pay us the shipping and insurance costs plus our handling fee of $16.75.

6. Items Not Claimed Within Six (6) Months:

In the event that we are not able to contact you using the information you supplied to us when registering to use our service, and your Item goes unclaimed, we shall be entitled to take possession and ownership of said Item and to dispose of said Item as we see fit. You expressly authorize us to dispose of the Item in any manner we deem appropriate and to retain all proceeds from the sale or disposal of the Item as compensation for our storage of the Item and efforts to contact you. We shall not be liable for any damages to any person or corporation with regards to items or valuables unclaimed for a period of six (6) months from the date of our receipt of the Item.   It is your sole responsibility to contact us and to claim the Item within this time frame.  We will make exert all reasonable efforts to attempt to contact you in regard to this transaction.  Please make sure that you provide us with the correct information when you register to use our services.

After the expiration of the six (6) month period, any existing Offer to Purchase shall expire and all rights, duties and responsibilities herein shall expire and become null and void.

7. Limitation of Liability:

A. WeBuyWatches.com will have no liability for any Item while in transit or otherwise in the possession or custody of any party other than WeBuyWatches.com, including, without limitation, any common carrier, courier service, customs authority or other postal or delivery service. You must not send any Item(s) to WeBuyWatches.com unless you have insured the Item(s) for against loss in transit to WeBuyWatches.com for your full anticipated value or we have notified you that we have purchased insurance and shipping for the Item.
B. You agree that in the event there is a liability to us for the value of the Item sent to us, we will compensate you for the value of your Item based solely upon and determined by WeBuyWatches.com in its sole discretion and as an evaluator of watch values. Unless you provide to us a valid appraisal of your watch prior to sending it to us, you expressly acknowledge and agree that our determination of value shall be conclusive and binding.
C. WeBuyWatches.com reserves the right, in its sole discretion, to reject delivery of any mail, envelope, package or other material that appears damaged, opened or tampered with. Any such rejected material will be returned to you, and we will have no liability for any Item(s) in such packages.
D. Except as expressly provided in item Subsection B above, WeBuyWatches.com will have and assumes no liability whatsoever, whether arising in connection with the use of the Web Site or the services provided, the loss of any Item(s), or for any other reason, including, without limitation, WeBuyWatches.com 's own acts or omissions. WeBuyWatches.com will not be liable for any special, incidental, punitive, consequential or other similar damages (including, without limitation, loss of profit or opportunity).
E. OTHER THAN THOSE WARRANITES EXPRESSLY SET FORTH IN THIS AGREEMENT. ALL SERVICES PROVIDED THROUGH THIS WEB SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OR CONDITIONS OF ANY KIND.  SUBJECT TO THE EXPRESS TERMS OF THIS AGREEMENT, YOU AGREE THAT YOUR USE OF THIS SITE AND OUR SERVICES WILL BE AT YOUR SOLE RISK AND TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND EACH OF OUR ADVERTISERS, LICENSORS, SUPPLIERS, OFFICERS, DIRECTORS, INVESTORS, EMPLOYEES, AGENTS, SERVICE PROVIDERS AND OTHER CONTRACTORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED IN CONNECTION WITH THIS SITE AND YOUR USE OF IT AND OUR SERVICES. OTHER THAN THOSE WARRANITES EXPRESSLY SET FORTH IN THIS AGREEMENT, WE MAKE NO REPRESENTATIONS OR WARRANTIES ABOUT AND ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY (A) UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL OR FINANCIAL INFORMATION STORED ON THEM, (B) INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THIS SITE AND/OR (C) BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THIS SITE BY A THIRD PARTY.

8. Restrictions on your Use of the Web Site:

You are entirely responsible for any harm resulting from your use of this Web Site.  You represent and warrant that:
A. You will not use this Web Site for any unauthorized purpose including collecting user names and/or email addresses of other users by electronic or other means for the purpose of sending unsolicited email or other electronic communications;
B. You will not access this Web Site through the use of scripts, bots or other automated means;
C. You will not access this Web Site through any means other than through the interface that we provide to you or engage in unauthorized framing of, or linking to, this Web Site unless otherwise specifically authorized by us in a separate written agreement;
D. You will not transmit chain letters, bulk or junk email or interfere with, disrupt, or create an undue burden on this Web Site or the networks or services connected to this Web Site, including, without limitation, hacking into this Web Site;
E. You will not impersonate any other person or entity, provide false or misleading identification or address information, or invade the privacy, or violate the personal or proprietary right, of any person or entity;
F. You will not circumvent, disable or otherwise interfere with security related features of this Web Site or features that prevent or restrict use or copying of any Web Site Content or enforce limitations on use of this Web Site; or
G. You will not cause to appear any pop-up, pop-under, exit windows, expanding buttons, banners, advertisements or anything else that minimizes, covers or inhibits the full display of this Web Site.

9. Privacy Policy:

WeBuyWatches.com's privacy policy is posted at www.WeBuyWatches.com/legal/privacy.html. Such privacy policy, as amended from time to time, will be binding on you.

10. Binding Effect:

This Agreement, including, without limitation, the limitations of liability herein, will be binding on you and all third parties, including, but not limited to, your successors, assigns, insurance carriers and any other individual or entity asserting any right or claim relating to your transaction with WeBuyWatches.com. In no event will we be liable to any third party, including, without limitation, any insurance carrier. WeBuyWatches.com will not be liable for, and you waive, any subrogation claim brought by your insurance carrier on your behalf.

11. Choice of Law, Waiver and Claims.

This Agreement, and all WeBuyWatches.com transactions, will be governed by the laws of the State of Georgia, USA without regard to any conflict of law provisions. Our failure to exercise or enforce any rights or provisions of this Agreement will not be deemed to be a waiver of such right or provision. If any of the terms set out in this Agreement are found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other terms and conditions will remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the WeBuyWatches.com service or Web Site with WeBuyWatches.com must be filed within one (1) year after such claim or cause of action arose or be forever barred. Any such claim or cause of action must be filed in the Fulton County, Georgia. WeBuyWatches.com will be entitled to reimbursement for any and all costs incurred by it in defending any action filed or attempted to be filed in any jurisdiction outside of the Fulton County, Georgia, including but not limited to, attorney's fees incurred by WeBuyWatches.com. In the event of a favorable verdict, WeBuyWatches.com shall be entitled to reasonable attorney’s fees in any action.

12. Miscellaneous Provisions:

A. We expressly reserve the right to modify and amend this Agreement from time to time and without notice to you. We will post any revised versions of this Agreement on this Web Site so you should therefore regularly check this Web Site for any updates and revisions to this Agreement.
B. All information contained on this Web Site is protected by copyright laws of the United States of America.  Trademark, service mark and copyright rules and regulations apply.  No information on this Web Site may be copied, published, broadcast, or used in any way which violates U.S. or International laws, rules or regulations related to Intellectual Property without the expressed written consent of WeBuyWatches.com.
C. THESE TERMS AND CONDITIONS SUPERCEDE AND REPLACE ANY PREVIOUS VERSIONS OF THIS AGREEMENT AS WELL AS ANY INCONSISTENT STATEMENTS ON THE SITE OR OTHER MARKETING MATERIALS, OR ADVERTISEMENTS.
D. By shipping your goods to us, you are agreeing to all terms and conditions set forth herein and affirming, under penalty of perjury, that the information supplied by you is true and correct and that you are of legal age as required herein and the lawful owner of the property that this is the subject of your transaction with us.
